Description of Service

Campusist services which are located at: http://www.campusist.com. Campusist is an online entertainment commucity which let users share their common interests in movies, TV shows and music etc. You understand and agree that the Service is provided on an AS IS and AS AVAILABLE basis. Campusist.com disclaims all responsibility and liability for the availability, timeliness, security or reliability of the Service. Campusist.com also reserves the right to modify, suspend or discontinue the Service with or without notice at any time and without any liability to you.

Eligibility

You must be 18 or over, or the legal age to form a binding contract in your jurisdiction if that age is greater than 18 years of age, to register as a Campusist member or use the Campusist Site and Campusist Service. If you are under the age of 18 or the applicable legal age in your jurisdiction, you can use the Campusist Service only in conjunction with, and under the supervision of, your parent or guardian who has agreed to the Terms of Service. If you do not qualify, do not use the Service. Membership in the Campusist Service is void where prohibited by applicable law, and the right to access the Campusist Site is revoked in such jurisdictions. By using the Campusist Site and/or Campusist Services, you represent and warrant that you have the right, authority, and capacity to enter into these Terms of Service and to abide by all of the terms and conditions set forth herein.

In accordance with Federal Children's Online Privacy Protection Act of 1998 (COPPA)(which is available at http://www.ftc.gov/ogc/coppa1.htm), Campusist will never knowingly solicit nor will it accept personally identifiable information from users known to be under thirteen (13) years of age. Please see our Privacy Policy for additional information or how to notify us of any concerns in this regard.Campusist.com reserves the right to refuse service to anyone at any time without notice for any reason.

Proper Use

You agree that you are responsible for your own communications and for any consequences thereof. Your use of the Service is subject to your acceptance of and compliance with the Agreement. You agree that you will use the Service in compliance with all applicable local, state, national, and international laws, rules and regulations, including any laws regarding the transmission of technical data exported from your country of residence. You shall not, shall not agree to, and shall not authorize or encourage any third party to: (i) use the Service to upload, transmit or otherwise distribute any content that is unlawful, defamatory, harassing, abusive, fraudulent, obscene, contains viruses, or is otherwise objectionable as reasonably determined by Campusist.com; (ii) upload, transmit or otherwise distribute content that infringes upon another party's intellectual property rights or other proprietary, contractual or fiduciary rights or obligations; (iii) prevent others from using the Service; (iv) use the Service for any fraudulent or inappropriate purpose; or (v) act in any way that violates the Program Policies, as may be revised from time to time. Violation of any of the foregoing may result in immediate termination of this Agreement, and may subject you to state and federal penalties and other legal consequences. Campusist.com reserves the right, but shall have no obligation, to investigate your use of the Service in order to determine whether a violation of the Agreement has occurred or to comply with any applicable law, regulation, legal process or governmental request.

Content Posted By You on the Campusist Site.

* You may not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights.
* You understand and agree that Campusist may review and delete any Content (links, images, profiles, comments, postings, messages) that in the sole judgment of Campusist violates these Terms of Service or which might be offensive, illegal, or that might violate the rights of, harm, or threaten the safety of other users or members of the Campusist Site and/or other website users.
* You are solely responsible for the any Content that you publish or display on the Campusist Site or transmit to other members and/or other website users (hereinafter, "Posted Content").
* You are solely responsible for your ratings and comments on Campusist. Campusist reserves the right, but has no obligation, to monitor disputes between you and any site which you have posted.
* You agree that you will only post Content that you believe to be true and you will not purposely provide false or misleading information.
* By posting Posted Content on the Campusist Site, you agree to and hereby do grant, and you represent and warrant that you have the right to grant, Campusist, its contractors, and the users of the Campusist Site an irrevocable, perpetual, non-exclusive, royalty-free, fully sublicensable, fully paid up, worldwide license to use, copy, publicly perform, digitally perform, publicly display, and distribute such Posted Content and to prepare derivative works of, or incorporate into other works, such Posted Content.
* The following is a partial list of the kind of Content and communications that are illegal or prohibited on/through the Campusist Site. Campusist reserves the right to investigate and take appropriate legal action in its sole discretion against anyone who violates this provision, including without limitation, removing the offending communication from the Campusist Service and terminating the membership of such violators or blocking your use of the Campusist Service and/or Campusist Site. You may not post Content that:
o is false or intentionally misleading;
o is patently offensive to users of the Campusist Site, such as Content or messages that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
o harasses or advocates harassment of another person;
o involves the transmission of unsolicited mass mailing or "spamming";
o promotes illegal activities or conduct that is abusive;
o is threatening, obscene, defamatory or libelous;
o is pornographic or sexually explicit in nature; and
o seeks or recommends providers of material that exploits people under the age of 18 in a sexual or violent manner, or seeks or recommends providers that solicit personal information from anyone under 18.

Copyright Dispute Policy

Campusist has adopted the following general policy toward copyright infringement in accordance with the Digital Millennium Copyright Act or DMCA (posted at http://www.lcweb.loc.gov/copyright/legislation/dmca.pdf).

Campusist's Designated Agent to Receive Notification of Claimed Infringement ("Designated Agent") is provided at the bottom of this section.(Contact email: admin@campusist.com)

* Campusist Policy

It is Campusist's policy to (i) block access to or remove material that it believes in good faith to be copyrighted material that has been illegally copied and distributed by any of our advertisers, affiliates, Content providers, members or users; and (ii) remove and discontinue service to repeat offenders.
* Procedure for Reporting Copyright Infringements

If you believe that material or Content residing on or accessible through the Campusist Site or Service infringes a copyright, please send a notice of copyright infringement containing the following information to the Designated Agent listed below ("Proper Bona Fide Infringement Notification"):
1. A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has been allegedly infringed;
2. Identification of works or materials being infringed;
3. Identification of the material that is claimed to be infringing including information regarding the location of the infringing materials that the copyright owner seeks to have removed, with sufficient detail so that Campusist is capable of finding and verifying its existence;
4. Contact information about the notifier including address, telephone number and, if available, email address;
5. A statement that the notifier has a good faith belief that the material is not authorized by the copyright owner, its agent, or the law; and
6. A statement made under penalty of perjury that the information provided is accurate and the notifying party is authorized to make the complaint on behalf of the copyright owner.

# Upon Receipt of a Bona Fide Infringement Notification

Once Proper Bona Fide Infringement Notification is received by the Designated Agent, it is Campusist's policy:

1. to remove or disable access to the infringing material;
2. to notify the Content provider, member or user that it has removed or disabled access to the material; and
3. that repeat offenders will have the infringing material removed from the system and that campusist will terminate such Content provider's, member's or user's access to the service.

Representations and Warranties

You represent and warrant that (a) all of the information provided by you to Campusist.com to participate in the Services is correct and current; and (b) you have all necessary right, power and authority to enter into this Agreement and to perform the acts required of you hereunder.

Privacy

As a condition to using the Service, you agree to the terms of the Campusist.com Privacy Policy as it may be updated from time to time. Campusist.com understands that privacy is important to you. You do, however, agree that Campusist.com may monitor, edit or disclose your personal information, including the content of your emails, if required to do so in order to comply with any valid legal process or governmental request (such as a search warrant, subpoena, statute, or court order), or as otherwise provided in these Terms of Use and the Campusist.com Privacy Policy. Personal information collected by Campusist.com may be stored and processed in any country in which Campusist.com or its agents maintain facilities. By using Campusist.com, you consent to any such transfer of information outside of your country.

Advertisements

As consideration for using the Service, you agree and understand that Campusist.com may display ads and other information adjacent to the content of videos and comments. Campusist.com serves relevant ads using a completely automated process that enables Campusist.com to effectively target dynamically changing content.

Account Inactivity

After a period of inactivity, Campusist.com reserves the right to disable or terminate a user's account. If an account has been deactivated for inactivity, the email address associated with that account may be given to another user without notice to you or such other party.

Termination; Cancellation

You may cancel your use of the Services and/or terminate this Agreement with or without cause at any time by providing notice to Campusist.com, however a terminated account may continue to exist for up to ten business days before such cancellation takes effect. Campusist.com may at any time and for any reason terminate the Services, terminate this Agreement, or suspend or terminate your account. In the event of termination, your account will be disabled and you may not be granted access to your account or any files or other content contained in your account although residual copies of information may remain in our system. Campusist.com will notify you via email of any such termination or cancellation, which shall be effective immediately upon Campusist.com's delivery of such notice.

Indemnification.

You agree to hold harmless and indemnify Campusist.com, and its subsidiaries, affiliates, officers, agents, and employees from and against any third party claim arising from or in any way related to your use of the Service, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys' fees, of every kind and nature. In such a case, Campusist.com will provide you with written notice of such claim, suit or action.
